Article 1 – Definitions

In these terms and conditions:

  • Reflection period: the period within which the consumer may exercise the right of withdrawal.
  • Consumer: a natural person not acting for business purposes who enters into a distance contract with the entrepreneur.
  • Day: a calendar day.
  • Durable data carrier: any medium that allows the consumer or entrepreneur to store information for future reference.
  • Right of withdrawal: the option for the consumer to withdraw from the agreement within the reflection period.
  • Entrepreneur: the natural or legal person who offers products or services to consumers via distance selling.
  • Distance contract: an agreement concluded via an organized system for distance selling without the simultaneous physical presence of the parties.
  • Technique for distance communication: means of communication that allow conclusion of a contract without the consumer and entrepreneur being in the same place at the same time.

Article 2 – Applicability

These general terms and conditions apply to every offer and every distance contract concluded between Fashioncheck and the consumer.

Before concluding a distance contract, the text of these terms and conditions will be made available electronically or otherwise in a way that the consumer can easily store it.

If specific product or service conditions apply in addition, the consumer can rely on the provision most favorable to them in the event of conflicting terms.

Article 3 – The Offer

If an offer has a limited validity or is subject to conditions, this will be clearly stated.

All product descriptions and images are created to represent the offer as accurately as possible.

Obvious errors or mistakes in the offer are not binding.

Each offer clearly states the rights and obligations associated with acceptance, including:

  • the total price including taxes and any delivery costs,
  • the method of payment and delivery,
  • the existence or absence of a right of withdrawal,
  • and the duration of the offer.

Article 4 – The Agreement

The agreement is established when the consumer accepts the offer and meets the stated conditions.

If the consumer accepts electronically, Fashioncheck will confirm receipt of the acceptance immediately by email.

Fashioncheck uses secure SSL encryption to protect all data transmissions.

If the entrepreneur cannot fulfill an order, the consumer will be informed as soon as possible and refunded within 7 days.

Article 5 – Right of Withdrawal (Returns)

The consumer has the right to withdraw from the agreement within 14 days after receiving the product, without stating a reason.

During this period, the consumer must handle the product and packaging carefully and only inspect it as necessary to determine whether they wish to keep it.

To exercise this right, the consumer can start the return process through the online return form on the website.

Article 6 – Costs and Refunds in Case of Withdrawal

If the consumer uses the right of withdrawal, only the return shipping costs are at their expense.

Fashioncheck will refund any payments received within 7 days after receiving the returned goods, provided the items are in original condition and packaging.

Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • products made to the consumer’s specifications,
  • items of a personal nature,
  • hygiene products that cannot be returned once opened,
  • products that deteriorate quickly or have a limited shelf life.

Article 8 – Prices

All prices include VAT.

Prices will not change during the validity period of the offer, except for VAT or legal changes.

We may offer variable prices for products influenced by market factors beyond our control.

Article 9 – Conformity and Warranty

Fashioncheck guarantees that the products comply with the agreement, are as described, and meet normal expectations of reliability and usability.

If a product shows a defect upon arrival, please contact info@fashionccheck.com within 4 working days.

Article 10 – Delivery and Execution

Orders are handled with the utmost care.

Delivery takes place at the address provided by the consumer.

We aim to deliver within 1–3 working days.

A shipping contribution of €4.99 applies per order.

The risk of damage or loss lies with Fashioncheck until the product is delivered to the consumer.

Article 11 – Payment

Unless otherwise agreed, payment must be made within 14 days after delivery.

Fashioncheck offers secure payment methods through recognized providers.

The consumer must report any inaccuracies in provided payment details immediately.

Article 12 – Complaints

Complaints must be submitted clearly and completely to info@fashionccheck.com within a reasonable time after discovery.

We respond within 14 days.

If a complaint requires more time, you will receive a confirmation and an indication of when you can expect a detailed reply.

Article 13 – Force Majeure

If a product is unavailable due to force majeure, the purchase amount will be refunded.

Article 14 – Intellectual Property

All intellectual property rights related to the website, its design, and content belong to Fashioncheck, its partners, or licensors.

Reproduction or use without written permission is prohibited.

Article 15 – Personal Data

Fashioncheck processes customer data in accordance with its [Privacy Policy] and applicable GDPR regulations.

Article 16 – Applicable Law

All agreements and disputes are governed exclusively by Dutch law.

Any disputes will be submitted to the competent court in the Netherlands.
